29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system.  The employer is failing to protect employees from fall hazards when working on a residential structure. This was most recently documented on or about March 11, 2021 at 9602 S 183rd St, Omaha, Nebraska when employees were observed painting a residential structure without fall protection. The employees were painting while working at a height of over 6 feet without fall protection.

The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The employer is failing to train all employees that were potentially exposed to fall hazards to enable each employee to recognize the hazards associated with the type of work being accomplished. The employer is failing to protect employees from fall hazards when working on unstable and unlevel ladders. This was most recently documented on or about March 11, 2021 at 9602 S 183rd St, Omaha Nebraska. An employee was observed performing painting activities at a residential structure while working from a ladder that was situated near the edge of a pitched roof of a newly constructed residential home. The ladder was being held by another employee.
