29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to to fall hazards from climbing job-made ladders: a) Building B (North section of building): On or about March 12, 2021, and at times prior, employees were exposed to fall hazards of 11 feet 2 inches while using a wooden job-made ladder without filler blocks to access the third story of the building. b) Building B (South section of building): On or about March 12, 2021 and at times prior, employees were exposed to fall hazards of 11 feet 1 inches while using two wooden job-made ladders without filler blocks to access the second story of the building.

29 CFR 1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing hazards): A) Building B (whole building): On or about March 12, 2021 and at times prior, Pavilion Construction, the controlling and exposing employer, failed to ensure that it's employees and employees of it's subcontractors were protected from jobsite hazards, including but not limited to, fall hazards and tripping hazards due to the lack of effective frequent and regular inspections being conducted by a competent person.

29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): A) Building B (whole building): On or about March 12, 2021 and at times prior, Pavilion Construction, as the controlling and exposing employer, failed to ensure that it's employees and employees of it's subcontractors were protected from fall hazards of 11 feet 1 inches while working near loading areas/wall openings without complete guardrail systems, safety net systems, or personal fall arrest systems in place. B) Building B (North section of building): On or about March 12, 2021 and at times prior, Pavilion Construction, as the controlling and exposing employer, failed to ensure that it's employees and employees of it's subcontractors were protected from fall hazards of 11 feet 2 inches while using a ladder to access the third story of the building. Third story ladder access point did not have complete guardrail systems, safety net systems, or personal fall arrest systems in place. C) Building B (South section of building): On or about March 12, 2021 and at times prior, Pavilion Construction, as the controlling and exposing employer, failed to ensure that it's employees and employees of it's subcontractors were protected employees were protected from fall hazards of 11 feet 1 inches while using two ladders to access the second story of the building. Second story ladder access point did not have complete guardrail systems, safety net systems, or personal fall arrest systems in place. D) Building B (center of North and South sections): On or about March 12, 2021 and at times prior, Pavilion Construction, as the controlling and exposing employer, failed to ensure that it's employees and employees of it's subcontractors were protected from fall hazards of 11 feet 1 inches while walking and working near an open elevator shaft. Area near elevator shaft did not have complete guardrail systems, safety net systems, or personal fall arrest systems in place.
