29 CFR 1926.304(d):When the tool was withdrawn from the work, the lower guard did not automatically and instantly return to the covering position. On the north side of the construction site, employees operating a Makita skill saw with lower guard wedged in the up position while cutting framing material were expose to cuts and scrape hazards.

On the north side of the construction site, employees engaged in framing work without fall protection were exposed to unprotected fall hazards of approximately 9 feet to the ground below.
