29 CFR  1926.451(f)(7):Scaffolds shall be erected, moved, dismantled, or altered only under the supervision and direction of a competent person qualified in scaffold erection, moving, dismantling or alteration. Such activities shall be performed only by experienced and trained employees selected for such work by the competent person.  On or about March 22, 2021, the employer failed to ensure that the ladder jack scaffold was erected by a competent person. This exposed employees to fall hazards of 20 feet, 8 inches when working on the scaffold.   Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).

Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    On or about March 22, 2021, employees were exposed to fall hazards approximately 22 feet high while engaged in residential roofing activities.  Fall protection was not being utilized while performing roofing operations.       Juan Mayancela Construction Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) which was contained in OSHA inspection number 1413196, citation 1, item 1, and was affirmed as a final order on October 30, 2019, with respect to a worksite located at 470 Raintree Dr., Oswego, IL.  No abatement certification or documentation required for this item.
