29 CFR  1910.1026(k)(1)(i)(A): The employer did not make medical surveillance available for all employees who were or could be occupationally exposed to chromium (VI) at or above the action level for 30 or more days a year:  Building 2:  On or about May 3, 2021, employees engaged in operations that require frequent exposures to hexavalent chromium in building 2 were not provided with medical surveillance to determine potential adverse health effects. An exposure assessment performed on May 03, 2021, showed that employees working in the Paint Shop Room, Etch Line Room, and Sanding Room in Building 2 were exposed to an 8-hr concentration of 16�g/m3, which exceeded OSHA's 5�g/m3 PEL, requiring the need for medical surveillance.

29 CFR  1910.1026(c): The employer did not ensure that no employee was exposed to an airborne concentration of chromium (VI) in excess of 5 micrograms per cubic meter of air (ug/m3), calculated as an 8-hour time-weighted average (TWA).  Building 2 Paint Shop:  On or about, and at times after May 03, 2021, employees that were assigned to Building 2 Paint Shop were exposed to hexavalent chromium (Cr6+) in exceedance of OSHA's permissible exposure limit (PEL) with an 8-hour time-weighted average (TWA) concentration of 16�g/m3. Employees were exposed to Cr6+ while performing preparation, mixing, and painting with a 515X410 Base Component containing >20 - <22% strontium chromate and 3M Scotch-Weld Structural Adhesive Primer EC-3917 containing 1-5% strontium chromate. Additional exposures were noted during electroplating operations with one dip tank containing an Alodine solution of 50-60% chromium (VI) oxide and another containing sulfuric acid sodium dichromate at 100%.

29 CFR  1910.1026(l)(1)(iii): The employer did not include chromium (VI) in the hazard communication program established to comply with the HCS (� 1910.1200);  did not ensure that each employee has access to labels on containers of chromium (VI) and to safety data sheets; and that each employee was trained in accordance with the requirements of HCS and paragraph (l)(2) of this section:   a) Building 11:  On or about April 28, 2021, employees performing electroplating with a dip tank of hexavalent chromium (Cr6+) compounds, located in the CAD Plating Shop of building 11, were not provided with general information regarding the physical and health hazards of the chemical in the tank.  Additional Cr6+ exposures during the cadmium plating process had not been reviewed with employees.  Employees were unaware of the hazards of the chemicals they were handling while performing their duties, and had not been provided adequate training on these exposures or the requirements and purpose of the Hexavalent Chromium Standard.   b) Building 2: On or about May 03, 2021 employees working in the Etch Line Room, Paint Shop Room, and Sanding Room were unaware that the products they used during mixing, prep, and painting operations were Cr6+ containing. The employer did not ensure that employees were aware of the required control measures and the adverse effects associated with exposures to this carcinogen.

29 CFR  1910.1200(f)(6)(ii): Except as provided in 29 CFR 1910.1200(f)(7) and 29 CFR 1910.1200(f)(8), the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the product identifier and words, pictures, symbols, or combination thereof, which provide at least general information regarding the hazards of the chemicals and which, in conjunction with the other information immediately available to employees under the hazard communication program, would provide employees with the specific information regarding the physical and health hazards of the hazardous chemical.  Building 2 Etch Line Room:  On or about April 28, 2021, the employer did not ensure that dip tanks in the Etch Line room of Building 2 were labeled with information about the identity and the hazards of the tank contents. Employees frequently work in the room performing electroplating tasks. Tanks stored in the room included 11 Dip tanks labeled: phosphoric acid, spray DI water, four immersion DI rinse water tanks, DI water, spray rinse, sulfuric acid sodium dichromate, alkaline cleaner, spray rinse, and Alodine 1200s.

29 CFR  1910.1026(d)(1): The employer with a workplace or work operation covered by this standard did not determine the 8-hour time-weighted average exposure for each employee exposed to chromium (VI):  a) Building 2:  On or about May 3, 2021, the employer did not make a determination of employee exposure to hexavalent chromium (Cr(VI)) during electroplating, mixing and preparation, painting, and paint removal operations on small aircraft parts. Employees in the Building 2 Paint Shop performed tasks that included Cr(VI) mixing, preparation, and sanding with a Duracoat putty containing 10-20% Cr(VI) trioxide that was mixed with an Evercoat Polyester Glazing Putty. Also, a 515X410 Base Component containing 20% strontium chromate and an M&D Activator Component was mixed then spray painted onto small parts. Additional spray painting in building 2 was done with a 3M Structural Adhesive Primer EC-3917 that contained a 1-5% strontium chromate concentration. Employees also worked in an Etch Line room (connected to the Paint Shop room), which included a process line of one dip tank containing 100% strontium chromate and another dip tank containing 50-60% Cr(VI) oxide Alodine solution. An exposure assessment performed by OSHA during the inspection resulted in an exceedance of the 5ug/m3 PEL in building 2 with an 8hr TWA concentration of 16�g/m3.   b) Building 11:  On or about April 28, 2021, plating operations performed in building 11 also included the use of a Duracoat product containing 10-20% chromic acid while cadmium plating and performing electroplating operations in a small dip tank containing a 50-60% Cr(VI) oxide Alodine solution. Cr(VI) samples retrieved from building 11 resulted in exposure levels below the PEL with an 8hr TWA concentration of 0.07 �g/m3.

Some of the known hazards present included, but were not limited to, an Alodine 1200S solution of 50-60% chromium (VI) oxide, a solution of sulfuric acid sodium dichromate at 100%, a Duracoat putty containing 10-20% Cr(VI) trioxide, 515X410 Base Component containing 20% strontium chromate, 3M Structural Adhesive Primer EC-3917 that contained a 1-5% strontium chromate concentration, 99.5-100% Methyl ethyl ketone wipes, and Cadmium No-Bake containing 15-20% cadmium sulphate.
