29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or about January 12, 2021, an employee was performing roof work on a two story residential home at heights up to 26 feet without appropriate means of fall protection. The employee fell and landed on the ground below, resulting in an in-patient hospitalization. The employer did not initiate and maintain safety and health programs related to the roofing work being conducted by the employee.

29 CFR  1926.21(b)(2):The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.  a.  On or about January 12, 2021, an employee was performing roof work on a two story residential home at heights up to 26 feet without appropriate means of fall protection. The employee fell and landed on the ground below, resulting in an in-patient hospitalization. The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to their environment to minimize risk of injuries.

29 CFR  1926.501(b)(13):"Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or about January 12, 2021, the employer did not ensure an employee  engaged in residential construction activities was adequately protected from falls. An employee was performing roof work on a two story residential building at heights up to 26 feet without appropriate means of fall protection. The employee fell and landed on the ground below, resulting in an in-patient hospitalization.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  a. For an in-patient hospitalization which occurred on or about January 12, 2021, involving an employee fall related injury off a  two story residential roof approximately 26 feet in height, the employer did not report the hospitalization to OSHA within 24 hours.
