29 CFR  1926.20(b)(1):It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a) Soto Exterior Trim and Siding located at 1199 Ravine View Drive, Lot 2157, Galena, Ohio 43021: On and preceding March 24, 2021, the employer did not develop and maintain an effective safety and health program to ensure that hazards were identified and corrected onsite while employees performed siding work.

29 CFR  1926.102(a)(1):The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  a) Soto Exterior Trim and Siding located at 1199 Ravine View Drive, Lot 2157, Galena, ohio 43021: On and preceding March 24, 2021, the employer failed to ensure employees wore safety glasses while utilizing power tools that presented struck-by hazards to the eyes and face. Employees were using pneumatic nail guns and circular saws while siding a house. The employees were not utilizing eye protection, thereby exposing employees to struck-by hazards to the eyes.

29 CFR  1926.451(c)(2)(i):Footings shall be level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement.  a) Soto Exterior Trim and Siding located at 1199 Ravine View Drive, Lot 2157, Galena, Ohio 43021: On and preceding March 24, 2021, the employer did not ensure that footing were level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement. The poles of a pump jack scaffold were placed on mudsills which were them placed on previously disturbed, un-level ground, which exposed the employees to fall hazards up to 20 feet.

29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers.  a) Soto Exterior Trim and Siding located at 1199 Ravine View Drive, Lot 2157, Galena, ohio 43021: On and preceding March 24, 2021, the employer did not ensure that employees engaged in work from a pump jack scaffold were protected from falls to a lower level. Sides were installing trim and siding to the second story. The employees were not protected from falls by any means of fall protection, which exposed them to falls up to 20 feet.
