29 CFR  1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)DeWitt Companies LLC at 212 Wildcat Drive, Sioux Falls, SD 57110:  On or about and at times prior to March 26, 2021, the exposing employer did not ensure that employees were protected from falls when working from heights greater than six feet.  Employees were setting trusses while standing on the exterior top plate on a single-family home with no fall protection systems in place. This condition exposed employees to a fall hazard of approximately 11 feet.

29 CFR  1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a)DeWitt Companies LLC at 212 Wildcat Drive, Sioux Falls, SD 57110: On or about and at times prior to March 26, 2021, the exposing employer did not ensure that employees were trained to identify and correct fall hazards prior to working at heights greater than six feet.  Employees were conducting framing operations on a single-family home with no fall protection systems in place and had not received fall protection training. This condition exposed employees to fall hazards greater than 10 feet.  Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:  a)	The nature of fall hazards in the work area; b)	The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used; c)	The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;  d)	The role of each employee in the safety monitoring system when this system is used; e)	The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; f)	The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and g)	The role of employees in fall protection plans; h)	The standards contained in this subpart.

29 CFR  1926.1053(b)(13):The top or top step of a stepladder shall not be used as a step:  (a)DeWitt Companies LLC at 212 Wildcat Drive, Sioux Falls, SD 57110: On or about and at times prior to March 26, 2021, the employer did not ensure that employees were utilizing ladders appropriately. Employees were utilizing step ladders to access top plates and truss cords which required employees to use  the top step of the step ladder.  This condition exposed employees to fall hazards greater than 10 feet.

29 CFR  1926.1060(a):The employer did not provide a training program for each employee using ladders and stairways, as necessary, which would enable each employee to recognize hazards related to ladders and stairways and train each employee in the procedures to be followed to minimize these hazards:  (a) DeWitt Companies LLC at 212 Wildcat Drive, Sioux Falls, SD 57110: On or about and at times prior to March 26, 2021, the employer did not ensure that employees were trained to recognize the hazards of working from ladders and the procedures to minimize these hazards. This condition exposed employees to fall hazards greater than 10 feet.  Abatement Note:  The employer shall ensure that each employee has been trained by a competent person in the following areas, as applicable:  (a)	The nature of fall hazards in the work area;  (b)	The correct procedures for erecting, maintaining, and disassembling the fall protection systems to be used;  (c)	The proper construction, use, placement, and care in handling of all stairways and ladders;  (d)	The maximum intended load-carrying capacities of ladders; and  (e)	The standards contained in this subpart.
