29 CFR  1926.651(k)(1): An inspection of the excavations, the adjacent areas, and protective systems was not conducted by the competent person prior to the start of work and as needed throughout the shift:  (a) ROBERTS EXCAVATION CORPORATION - at North West of South Overland Trail and Prospect Road intersection located in Fort Collins, CO 80526: On or before April 1, 2021, the employer did not ensure that daily inspections of an excavation and the adjacent area were made by the competent person for evidence of a situation that could have resulted in a hazardous condition, in that employees worked inside a trench that was approximately 8 feet deep, 5 feet wide, had nearly vertical walls and did not have a protective system.  This condition exposed employees to a crushing hazard by excavation wall collapse.  Note:  "Competent person" means one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.
