29 CFR  1926.501(b)(2)(ii): Each employee on a walking/working surface six feet (1.8 m) or more above a lower level where leading edges were under construction, but who was not engaged in the leading edge work, was not protected from falling by a guardrail.   At 21221 W 94th Terrace in Lenexa, Kansas, employees were seen performing framing activities without fall protection. Employees were exposed to fall hazards of 14 feet below.

29 CFR  1926.602(c)(1)(ii): No modifications or additions which affect the capacity or safe operation of the equipment shall be made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. In no case shall the original safety factor of the equipment be reduced.   At 21221 W 94th Terrace in Lenexa, Kansas, employees were lifted in a wooden job made basket and was not approved by the manufacturer. The employees were exposed to fall hazards that could cause serious injury or death.

29 CFR  1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:   At 21221 W 94th Terrace in Lenexa, Kansas, employees were exposed to fall hazards because the ladder they were using did not extend at least 3 feet above the upper landing of the surface they were accessing. The ladder is used throughout the day to gain access to the roof of the structure they are building.
