29 CFR  1926.651(c)(2):A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:  (a)  17591 KURTZ SCHOOL ROAD, NEW HOME DEVELOPEMENT - Employees entered and exited an approximate seven foot deep trench, and the employer had not utilized a ladder or an adequate ramp, as the egress point that was being used consisted of some loose spoil near the bottom of the trench and a mostly vertical wall near the top of the trench, on or about April 7, 2021.  No abatement certification or documentation required.

29 CFR 1926.652(c)(2)(i): Design of support systems, shield systems, or other protective systems that are drawn from manufacturer's tabulated data were not in accordance with all specifications, recommendations, and limitations issued or made by the manufacturer:  (a)	17591 KURTZ SCHOOL ROAD, NEW HOME DEVELOPEMENT - Employees entered and exited an approximate seven foot deep trench where a 20 foot long by 10 foot high by 40 inch wide protective shield system was being used for protection.  The employer had only installed five of the six support struts between the sides of the trench box, on or about April 7, 2021.  Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
