29 CFR  1926.100(a):Employees working in areas where there is a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns, shall be protected by protective helmets.  On or about March 30, 2021 and March 31, 2021 at the Verville Road Construction Project, employees were working in an excavation exposed to struck by hazards from rocks and soil and from the forms and lumber that were loosely leaning against the excavation walls and foundation panels as well as from the unsecured foundation form carriers.   No hard hats were worn.

29 CFR  1926.651(j)(1): Adequate protection was not provided to protect employees from loose rock or soil that could pose a hazard by falling or rolling from an excavation face:   On or about March 30, 2021 and March 31, 2021 at the Verville Road Construction Project, employees were working in an excavation exposed to struck by hazards from rocks and soil that were loosely in the excavation walls and on top of the excavation walls.  No hard hats were worn.
