29 CFR  1926.501(b)(1):"Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a.)  On or about April 5, 2021, employees were exposed to falls hazards such as but not limited to a 9-foot 6-inch fall from an unprotected edge on a walking/working surface while performing  masonry work above a concrete water filter pit located inside a water treatment facility.

29 CFR  1926.20(b)(2):Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  a.) On or about April 5, 2021, the employer did not conduct adequate frequent and regular inspections of the job site, materials and equipment being used thus exposing employees to a to falls hazards such as but not limited to a 9-foot 6-inch fall from an unprotected edge on a walking/working surface while performing masonry work above a concrete water filter pit located inside a water treatment facility.

29 CFR  1926.502(a)(2):Employers shall provide and install all fall protection systems required by this subpart for an employee, and shall comply with all other pertinent requirements of this subpart before that employee begins the work that necessitates the fall protection.  a.)  On or about April 5, 2021, the employer failed to install a fall protection system before employees starting performing masonry work above a concrete water filter pit located inside a water treatment facility and thus exposed the employees to a 9-foot 6-inch fall hazard.
