29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l).  a) On or about April 7, 2021, a  JLG Skytrak with a piece of plywood on the forks was used to lower employees from a walking/working surface to the ground and used to raise and lower materials to elevated surfaces of the building.  The employer did not ensure that each operator of the Skytrack successfully completed training and evaluation.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR  1926.451(c)(2)(v): Fork-lifts were used to support scaffold platforms while the entire platform was not attached to the fork and the fork-lift was moved horizontally while the platform was occupied.  a) On or about April 7, 2021, at the previously addressed job site, a JLG Skytrak was used to support a plywood scaffold platform while lowering and transporting an employee without being attached/secured to the forks.   Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
