29 CFR  OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to struck by and crushing hazards:   a) At the Steuben County Landfill, in cell #4 dumping area, on or about 4/09/21:  An employee was struck and killed while standing outside of his vehicle near the latching mechanism for the gate on his truck.  The employee was not wearing a high visibility vest.  The employer did not ensure that employees were protected from being struck by vehicles driving through the yard in close proximity to employees.  Abatement Documentation is required for this item.

29 CFR  1904.39(a)(1):Within eight (8) hours after the death of any employee as a result of a work-related incident, the employer did not report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  a) On or about 4/09/21 Superior Septic LLC did not report the fatality of their employee at the Steuben County Landfill within 8         hours.
