Employees were exposed to airborne dust while cutting the concrete floor with a handheld circular power saw and a walk-behind gas powered concrete saw.

29 CFR  1926.1153(e)(2):Respiratory protection program. Where respirator use is required by this section, the employer shall institute a respiratory protection program in accordance with 29 CFR 1910.134.  (a) Worksite- On or about April 16, 2021, the employer had not developed and implemented a written respiratory protection program with worksite specific procedures for employees that were required to use respirators, such as but not limited to, N95 respirators and elastomeric half mask while cutting a concrete floor with a handheld circular power saw and a walk-behind gas powered concrete saw. The employer did not institute a respiratory protection program as required for employees that were exposed to respirable crystalline silica.

29 CFR 1926.1153(g)(1): The employer did not establish and implement a written exposure control plan that contained at least the elements of paragraph(s) 1926.1153(g)(1)(i) through (iv):   (a) Worksite- On or about April 16, 2021, The employer did not establish and implement a written exposure control plan to determine the exposure of each employee who is or may reasonably be expected to be exposed to respirable crystalline silica. Two employees were permitted to perform indoor concrete cutting operations in a basement area using walk-behind gas powered concrete saw and another employee was permitted to walk and work near the cutting area.

29 CFR  1926.1153(i)(2)(i):The employer did not ensure that employees covered by this section could demonstrate knowledge and understanding of at least the requirements outlined in 29 CFR 1926(i)(2)(i)(A) through (F) where there was exposure to respirable crystalline silica:  (a)	Worksite- On or about April 16, 2021, The employer did not ensure that employees cutting a concrete floor in a basement area could demonstrate knowledge and understanding of silica hazards. Employees were exposed to respirable crystalline silica  while using a Skilsaw handheld power circular saw and a Felker walk-behind  gas powered concrete saw to cut the concrete floor without any training related to silica hazards.
