29 CFR  OSH ACT of 1970 Section (5)(a)(1):Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to struck by and crushing hazards:  a) At the Steuben County Landfill, in cell #4 dumping area, on or about 4/09/21: an employee was exposed to the hazard of being struck while working outside of his vehicle unlatching (or latching) the gate on his truck. The employer did not ensure that employees were protected from being struck by vehicles driving in the reverse and forward directions in close proximity to the employees.  b) Employees are exposed to a struck by hazard as they walk in and around collection and dump areas without a high visibility protective vest and may not be seen by other drivers.  Among other feasible and acceptable means of abatement would be:         a)     Train employees in regards to the hazards associated with dumping at a landfill as outlined in ANSI Z245.1 (2008) Standard                 section 6.1.3.2.        b)     Establish and implement a written hazard assessment program to address hazards associated with landfill operations,                  including the prevention of struck by hazards, as outlined in ANSI 245.1 (2008)Standard, section 9.2 and 9.3.       c)     Comply with the provisions contained within ANSI/ISEA 107-2010, High visibility safety apparel and headwear.      d)      Train employees to park defensively and back up safely as recommended by SWANA (Solid Waste Association of North                  America) Backing Best Management Practices Guide.  Abatement Documentation is required for this item.
