29 CFR  1926.95(c): Personal protective equipment was not of safe design and construction for the work to be performed:  On or about April 20, 2021, and at times prior thereto, employees were exposed to a fall hazard of greater than 6 feet,  while using a Werner UpGear Reusable Roof Anchor, model A210402,  that was not manufactured and designed to be used on a horizontal lifeline system.

29 CFR  1926.501(b)(2)(i):Each employee who was constructing a leading edge 6 feet or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:Note:  If the employer could demonstrate that it was infeasible or created a greater hazard to use these systems, a fall protection plan meeting the requirements of paragraph (k) of 1926.502 should have been developed and implemented.  On or about April 20, 2021,  employees were exposed to a fall hazard of greater than 6 feet to the ground level below, while framing without the use of fall protection equipment.
