29 CFR  1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   a) 3419 Tall Tree Lane, Baldwinsville, NY  13027, on or about 4/23/21:  Employees were working from a sheathing a 6:12 pitch roof with a ground to eave height of 19 feet, without fall protection of any kind.

29 CFR  1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502:  a) 3419 Tall Tree Lane, Baldwinsville, NY  13027, on the roof, on or about 4/23/21:  Employees were sheathing a 6:12 pitch roof with a ground to eave height of 19 feet, without fall protection of any kind.

29 CFR  1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access .   a) 3419 Tall Tree Lane, Baldwinsville, NY  13027, on or about 4/23/21:  Employees were using a 10 foot step ladder to access the roof surface from inside the footprint of the building (second story), where that ladder extended only one foot from the surface being accessed.
