29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Maximum Civil Construction, Inc., at 8500 Pena Blvd Denver, CO 80249: On April 23, 2021, the employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of 1910.1200 for labels and other forms of warning, safety data sheets, and employee information and training will be met. The employer did not have a hazard communication program that included respirable crystalline silica. Employees used a Bosch jackhammer to remove concrete for the addition of a bollard. Concrete contains crystalline silica. This condition exposed employees to a respirable crystalline silica hazard. Note: The requirements applicable to construction work under 1926.59 are identical to those set forth in 1910.1200.

The employer did not have the SDS for the ready mix concrete. Employees poured concrete after installing a bollard. Concrete contains crystalline silica. This condition exposed employees to a respirable crystalline silica hazard. Note: The requirements applicable to construction work under 1926.59 are identical to those set forth in 1910.1200.
