29 CFR  1926.651(j)(2):  Employees shall be protected from excavated or other materials or equipment that could pose a hazard by falling or rolling into excavations. Protection shall be provided by placing and keeping such materials or equipment at least 2 feet (.61 m) from the edge of excavations, or by the use of retaining devices that are sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary.  On or about April 23, 2021 at Reineking Court and South Drive in Plymouth, Wisconsin, employees were working from inside an excavation at seven feet deep without the spoil pile back two feet from the top edge.

29 CFR  1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems shall be made by a competent person for evidence of a situation that could result in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions. An inspection shall be conducted by the competent person prior to the start of work and as needed throughout the shift. Inspections shall also be made after every rainstorm or other hazard increasing occurrence. These inspections are only required when employee exposure can be reasonably anticipated.   On or about April 23, 2021 at Reineking Court and South Drive in Plymouth, Wisconsin, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the potential struck-by and/or crushing hazards and fall hazards associated with employees working from inside an excavation at seven to ten feet deep without the spoil pile back two feet from top edge, using walkways without guardrails, using a damaged ladder, and using excavation access ladder without side rails extended at least three feet above the top edge.

29 CFR  1926.651(l): Walkways shall be provided where employees or equipment are required or permitted to cross over excavations. Guardrails which comply with 1926.502(b) shall be provided where walkways are 6 feet (1.8 m) or more above lower levels. [59 FR 40730, Aug 9, 1994]   a)  On April 23, 2021 at Reineking Court and South Drive in Plymouth, Wisconsin, employees were on walkways seven feet above an excavation bottom surface without utilizing conventional fall protection equipment.  Two walkways, one on each side of a foundation pier, were installed for concrete work on three foundation piers without any form of fall protection.  b)   On April 23, 2021 at Reineking Court and South Drive in Plymouth, Wisconsin, an employee was walking/working from the top of a foundation pier seven feet above concrete slab base within an excavation without utilizing conventional fall protection equipment.

29 CFR  1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab-rail, shall be provided to assist employees in mounting and dismounting the ladder.   On or about April 23, 2021 at Reineking Court and South Drive in Plymouth, Wisconsin, employees were using a portable ladder to access/egress a seven and one half foot deep excavation without side rails extending at least three feet above upper landing.  The ladder side rails extended one foot eight inches above top edge.

29 CFR  1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, shall either be immediately marked in a manner that readily identifies them as defective, or be tagged with "Do Not Use" or similar language, and shall be withdrawn from service until repaired.   On or about April 23, 2021 at Reineking Court and South Drive in Plymouth, Wisconsin, employees were using a damaged portable ladder to access/egress a seven feet deep excavation.

29 CFR  1926.652(a)(1): Each employee in an excavation shall be protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section.  On or about April 23, 2021 at Reineking Court and South Drive in Plymouth, Wisconsin, employees working in an excavation without cave-in protection were exposed to cave-in hazards between seven and ten feet deep.  Employees were constructing concrete forms within the excavation and using access/egress ladders positioned against the face of the walls.
