29 CFR 1926.451(b)(1):Each platform on all working levels of scaffolds shall be fully planked or decked between the front uprights and the guardrail supports as follows: a. On the exterior scaffold system, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 15, 2021, the employer failed to ensure that employees of subcontractor Isel Herrera were not exposed to a fall hazard of up to 32 feet while conducting stucco work from a scaffold system that was not fully planked. b. On the exterior scaffold system, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 15, 2021, the employer failed to ensure that employees of subcontractor Molamark Construction were not exposed to a fall hazard of up to 32 feet while conducting stucco work from a scaffold system that was not fully planked.

29 CFR 1926.451(g)(4)(xv): Crossbracing used in place of a midrail was unacceptable because the crossing point of two braces is between 20 inches (0.5 m) and 30 inches ((0.8 M) above the work platform or as a toprail when the crossing point of two braces is not between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The endpoints at each upright were more than 48 inches (1.3 m) apart. a. On the exterior scaffold system, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 15, 2021, the employer failed to ensure that employees of subcontractor Isel Herrera were not exposed to a fall hazard of up to 32 feet, in that a fall protection system, such as but not limited to, a complete guardrail system, to include a mid-rail and top-rail, was not properly utilized as the employees performed stucco work. b. On the exterior scaffold system, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 15, 2021, the employer failed to ensure that employees of subcontractor Molamark Construction were not exposed to a fall hazard of up to 32 feet, in that a fall protection system, such as but not limited to, a complete guardrail system, to include a mid-rail and top-rail, was not properly utilized as the employees performed stucco work.

On the second and third floor, at the elevator landing, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 20, 2021, and at times prior, an employee was exposed to a up to 29 feet fall hazard down the open elevator shaft and over the top of the 2.2 feet high partial wall down to the steps of the main foyer stairs, while conducting inspections, in that the employee was not protected by a fall protection system after removal of the guardrails by employees of C & K Drywall Services, Inc. b. On the second and third floor, at the elevator landings, at 22 Ocean Ridge Boulevard North in Palm Coast Florida: On or about April 15, 2021, the employer failed to ensure that employees of subcontractor Molamark Construction, Inc. were not exposed to a fall hazard of up to 29 feet down the open elevator shaft and over the top of the 2.2 feet high partial wall down to the steps of the main foyer stairs, in that they were not protected by a fall protection system after removal of the guardrails by employees of C & K Drywall Services, Inc. c.
