OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees from being struck-by material and falling rack components. a. Warehouse Area, rack location A01: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled A01 having bent/damaged braces, and missing bracing components was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. b. Warehouse Area, rack location A02: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled A02 having missing bracing components was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. c. Warehouse Area, rack location A04: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled A04 having bent/damaged supports was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. d. Warehouse Area, rack location E23: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled E23 having bent/damaged supports was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. e. Warehouse Area, rack location E25: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled E25 having bent/damaged supports was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. f. Warehouse Area, rack location E28: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled E28 having bent/damaged supports was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. g. Warehouse Area, rack location - 4 foot: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled 4 foot and 5 foot having bent/damaged supports was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired. h. Warehouse Area, rack location - 5 foot: On or about April 28, 2021, and at times prior, the employer exposed employees walking and operating powered industrial vehicles in the warehouse area to struck-by hazards, in that the employer did not ensure that the steel storage rack labeled 4 foot and 5 foot having missing bracing components was isolated until the damage was evaluated by a storage rack design professional and was not placed into service until repaired.
