Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    Location: 456 9th Street Hoboken, NJ 07030  - 2nd floor  a) Employees were exposed to fall hazards while conducting residential construction work on an elevated balcony platform approximately 20 feet above the next lower level without any means of fall protection. On 04/27/2021, an employee sustained a fatal fall while working on the balcony platform without any means of fall protection.

29 CFR  1904.39(a)(1):Basic Requirement.  Within eight (8) hours after the death of any employee as a result of a work-related incident, you must report the fatality to the Occupational Safety and Health Administration (OSHA), U.S. Department of Labor.  Location: 456 9th Street Hoboken, NJ 07030  - 2nd floor  a) Employee passed away on 5/15/21 due to head injuries sustained from fall hazards of approximately 20 feet while conducting balcony railing installation without a fall protection system in place on or about 4/27/21. The employer failed to report this fatality to OSHA within an 8 hours period.   Violation occurred on or about 5/15/2021.
