29 CFR  OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that untrained employees were exposed to fall hazards:  a. At a temporary worksite located at 1870 Mason Avenue, Daytona Beach, Florida: On or about April 23, 2021, the employer exposed employees to fall hazards, in that employees were assigned to operate a JLG  brand, model 2033E scissor lift,  without first receiving training on the set-up and operation of that lift.

29 CFR  1904.39(a)(2): The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye:  a. At a temporary worksite located at 1870 Mason Avenue, Daytona Beach, Florida: On or about April 23, 2021, an employee operating a JLG  brand, model 2033E, scissor lift, sustained a fall, was injured and hospitalized that same day. The employer did not report the work related hospitalization to OSHA within 24-hours of its occurrence.
