29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  (a) Plains Utilities and Excavating, LLC at the Marion Road Project, Sioux Falls, SD 57106:  On or about and at times prior to April 29, 2021, the employer did not ensure that employees conducting work in the north excavation were protected from cave-in, in that the excavation was approximately seven feet deep and lacked an adequate protective system such as sloping, benching, or shield system.  An employee was working at the bell end of the PVC water pipe exposed to a seven foot vertical wall as well as inadequate benching.  This condition exposed employees to struck-by hazards associated with a trench wall collapse.  (b) Plains Utilities and Excavating, LLC at the Marion Road Project, Sioux Falls, SD 57106:  On or about and at times prior to April 29, 2021 the employer did not ensure that employees conducting work in the south excavation were protected from cave-in, in that the excavation was approximately seven feet deep and lacked an adequate protective system such as sloping, benching, or shield system. This condition exposed employees to struck-by hazards associated with a trench wall collapse.
