29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part. a. On or about April 30, 2021, and at times prior, the employer had not initiated and maintained safety and health programs to prevent employees from being injured on job sites. Employees performed framing and siding work without adequate training and programs in place to protect them from fall hazards and struck-by hazards.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. a. On or about April 30, 2021, and at times prior, the employer did not ensure employees were adequately trained on personal protective equipment to ensure they were protected from fall and struck-by hazards. Employees were operating pneumatic nail guns and portable circular saws without the use of eye protection. Employees were also operating aerial lifts without the use of fall arrest systems.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation. a. On or about April 30, 2021, and at times prior, employees were operating portable circular saws and pneumatic nails guns to assemble framing for a pergola without utilizing eye protection. As a result, employees were exposed to struck-by hazards. b. On or about April 30, 2021, an employee was operating a pneumatic nail gun to frame in the third story pergola over the balcony without the use of eye protection. As a result, the employee was exposed to a struck-by hazard.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift. Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e). a. On or about April 30, 2021, an employee was observed working from a Genie S-65 Trax aerial boom lift without the use of a personal fall arrest system with a lanyard attached to the aerial life. As a result, the employee was exposed to falls of approximately 25-30 feet.
