29 CFR  OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that, employees were exposed to crush-by hazards.  (a) Facility- 1344 Greensburg Avenue, North Versailles, PA: On or about April 30, 2021, employees were exposed to crush-by hazards while using the Kubota Front End Loader to unload a delivery truck; the equipment operator exceeded the manufacturers lifting capacity for the plate mounted forks of 5,500lbs for the Kubota Front End Loader and the equipment became unstable and tipped over .

29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  (a) Various Jobsites- On or about May 4, 2021, employees cutting block were required to wear half-face cartridge respirators at various worksites and the employer did not establish a written respiratory protection program that included provisions in 29 CFR 1910.134(c)(1)(i)-(ix).
