29 CFR  1910.147(c)(1):Energy control program. The employer shall establish a program consisting of energy control procedures, employee training and periodic inspections to ensure that before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative.  The employer is failing to protect employees from stored energy by not establishing an energy control program. This was most recently observed at 11616 I Street, Omaha, NE 68137 on 03 May, 2021, where employees are authorized to lockout stored energy without energy control procedures, periodic inspections, or employee training. By not developing an energy control plan, employer is failing to ensure that machines or equipment is isolated from an energy source and rendered inoperative.

29 CFR  1910.178(g)(2):Facilities shall be provided for flushing and neutralizing spilled electrolyte, for fire protection, for protecting charging apparatus from damage by trucks, and for adequate ventilation for dispersal of fumes from gassing batteries.  The employer is failing to protect employees from an unprotected powered industrial truck charging apparatus that has visible damage from a collision. This was most recently observed at 11616 I Street, Omaha, NE 68137 on 03 May, 2021, where the employer has an unprotected powered industrial truck charging apparatus that is susceptible to damage from a powered industrial truck.

29 CFR  1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected.  The employer is failing to protect employees from hazards related to powered industrial trucks due to the lack of daily inspections of the trucks. This was most recently. observed at 11616 I Street, Omaha, NE 68137 on 03 May, 2021, where the employer has a powered industrial truck that is only examined when an outside agency preforms scheduled preventative maintenance on the powered industrial truck. Employees are exposed to the unexamined powered industrial truck throughout the work day.
