29 CFR  1926.20(b)(2):The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.  On or about May 6, 2021, and at times prior thereto, the employer did not ensure frequent and regular inspections were conducted where residential homes were under construction; exposing workers to hazards such as, but not limited to; falls and being struck by flying particles and falling materials.

29 CFR  1926.100(a):Employees were not protected by protective helmets while working in areas where there was a possible danger of head injury from impact, or from falling or flying objects, or from electrical shock and burns.   On or about May 6, 2021, and at times prior thereto, an employee was working on the ground below work being conducted at elevated heights without the use of a hardhat; exposing the employee to the hazard of being struck by falling materials.
