29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): Carlos Pena Construction LLC at 7043 Homeplace Castle Rock, CO 80108: On or before 5/8/21 the employer did not protect employees from injury in that employees were walking the top plate of a framed wall. This condition exposed employees to a fall hazard of 9 feet. Abatement Note: Abatement certification is required for this item. See enclosed "Certification of Corrective Actions Worksheet."

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step: Carlos Pena Construction LLC at 7043 Homeplace Castle Rock, CO 80108: On or before 5/8/21 the employer did not protect employees from injury in that employees climbed down from the top plate of a framed wall onto a step ladder. The ladder did not extend to a point where the employee could climb down safely without using the top or top step of the step ladder. This condition exposed employees to a fall hazard of 9 feet. Abatement Note: Abatement certification is required for this item. See enclosed "Certification of Corrective Actions Worksheet."
