29 CFR OSH ACT of 1970 Section (5)(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were not protected from struck-by and crushing hazards from an inadequately secured racking system. (a) Battery Warehouse, Front Section, South Wall: On or about May 10, 2021, employees performed battery sorting and battery charging duties next to and near industrial steel storage racks. The support column base plates on the frames of the racking system were not anchored to the floor to resist all applicable forces which exposed employees to struck-by and crushing hazards. (b) Battery Warehouse, Front Section, North Wall: On or about May 10, 2021, employees performed battery sorting and battery charging duties next to and near industrial steel storage racks. (c) WAREHOUSE, MIDDLE SECTION, NORTH WALL - Employees performed daily duties in the warehouse, and the exit route was reduced to a width of approximately 24 inches by a pallet of stacked batteries that had been placed in front of the door, on or about May 10, 2021. (d) WAREHOUSE, MIDDLE SECTION, SOUTH WALL - Employees performed daily duties in the warehouse, and the exit route was reduced to a width of approximately 16 inches by a pallet of stacked batteries that had been placed in front of the door, on or about May 10, 2021.
