29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about May 7, 2021, at the jobsite, the employer allowed an employee, that had not received Powered Industrial Truck (PIT) training as specified in paragraph (l), to operate a rough terrain forklift. This exposed employees to struck-by hazards.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about May 7, 2021, at the job site the employer did not ensure that employees working from the roof of a building were in use of fall protection. This exposed the employees to a fall hazard greater than six(6) feet to the ground below.
