On or about 5/12/2021, Town & Country Supermarkets, Inc. had not ensured that each powered industrial truck operator was competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training.

29 CFR 1910.178(p)(1):   A powered industrial truck was found to be in need of repair, defective, or in any way unsafe, the truck and was not  be taken out of service until it had been restored to safe operating condition.  On or about 5/12/2021, Town & Country Supermarkets, Inc. had not ensured that each powered industrial truck in need of repair, defective, or in any way unsafe was not  be taken out of service until it had been restored to safe operating condition.  A Crown Walkie Reach Pallet Stacker, Model # 30WRTT/SN# 6A133660, was missing a battery cover, an electrical cover on the bottom of the operator's control arm, and mast protective screen. The stacker had several damaged parts and had not been removed from service.

On or about 5/12/2021, Town & Country Supermarkets, Inc. had not ensured that each powered industrial truck was examined at least daily before being placed in service.
