29 CFR  1926.20(b)(2):The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s):   On or about May 14, 2021, during the operations of masonry work performed at a  commercial worksite located at 20820 Chagrin Blvd., Shaker Heights, OH 44122; the employer did not conduct frequent and regular inspections of the job site where employees were exposed to the hazards associated with the safe operation of an all terrain powered industrial vehicle.  Employees utilized Pettibone 6036 Telehandler serial #103 on varying grades and ground conditions which limited the ability of the vehicle to handle loads safely.

29 CFR  1926.28(a): The employer did not require the wearing of appropriate personal protective equipment in all operations where there is an exposure to hazardous conditions.   On or about May 14, 2021 the employer failed to ensure that operator(s) utilized the safety belt installed on the Pettibone 6036 Telehandler serial #103 while tasked with operation of the vehicle. This, with respect to a commercial construction worksite located at 20820 Chagrin Blvd., Shaker Heights, OH 44122.
