29 CFR  1926.100(a):Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  (a)Martinez J.R. LLC at 18 East Kansas City Street, Rapid City, SD 57701:  on or about and at times prior to May 18, 2021 the exposing employer did not ensure that employees that were protected by falling objects while performing stucco operations on a scaffolding system.  Employees were working on various levels of the scaffolding system and the lower level employees were not protected from falling objects by the use of protective helmets.  This condition exposed employees to struck-by hazards associated with tools and equipment being used on the upper levels of the scaffolding.

29 CFR  1910.1200(e)(1):The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  Martinez J.R. LLC at 18 East Kansas City Street, Rapid City, SD 57701:  On or about and at time prior to May 18, 2021 the exposing employer did not develop, implement, and/or maintain a written hazard communication program.  This condition exposed employees to hazards associated with the use of stucco materials/chemicals being used on site.  Abatement Note:  The requirements applicable to construction work under 29 CFR 1926.56 are identical to those set forth at 29 CFR 1910.1200 of this chapter.

29 CFR  1910.1200(h)(1):Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:   (a)Martinez J.R. LLC at 18 East Kansas City Street, Rapid City, SD 57701:  On or about and at time prior to May 18, 2021 the exposing employer did not ensure training was provided to employees prior to utilizing hazardous chemicals in their work area.  This condition exposed employees to hazards associated with the use of stucco materials/chemicals being used on site and no training prior to working with the chemicals.  Abatement Note:  The requirements applicable to construction work under 29 CFR 1926.56 are identical to those set forth at 29 CFR 1910.1200 of this chapter.
