29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite-specific procedures was not established and implemented for required respirator use:  a) Dr. Gertrude A. Barber Center DBA Barber National Institute, located at 8101 Gilbert St, Philadelphia, PA:   On or about May 12, 2021, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees to wear respirators such as but not limited to KN95 filtering facepiece respirators (GB2626-2006), while caring for  confirmed positive COVID-19 residents.

Barber Center DBA Barber National Institute, located at 8101 Gilbert St, Philadelphia, PA:  On or about May 12, 2021, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear respirators, such as KN95 filtering facepiece respirators (GB2626-2006), while providing care to confirmed positive COVID-19 residents.

Barber Center DBA Barber National Institute, located at 8101 Gilbert St, Philadelphia, PA:   On or about May 12, 2021, the employer did not provide a fit test to all employees required to wear respirators. The employer required employees to wear KN95 filtering facepiece respirators  (GB2626-2006) to protect against the SARS-CoV-2 virus while providing care to confirmed positive COVID-19 residents.

Barber Center DBA Barber National Institute, located at 8101 Gilbert St, Philadelphia, PA:   On or about May 20, 2021, the employer did not record a work-related COVID-19 illness of an employee on the OSHA 300 log or its equivalent. Residential Aid assigned to work with COVID-19 positive residents tested positive for COVID-19 on May 13, 2021.
