29 CFR  1926.652(a)(1):Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c).  a)  On or about 05/20/2021, on Retsof Road, in the town of York, during the replacement and reconnection of water services between Retsof Road and Evans Avenue, the employer did not enforce the use of a trench box or other protective systems to prevent cave-ins of the trench walls.  Employees were exposed to potential trench wall collapse during the excavation, where heavy equipment (excavator) was in use.  NO ABATEMENT CERTIFICATION REQUIRED
