29 CFR  1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met.  a) On or about June 3, 2021, the employer did not develop, implement, and maintain a written hazard communication program for chemicals such as but not limited to Pyroil Starter Fluid (flammable, inhalation hazard) and Carquest Wearever Brake Parts Cleaner (flammable, skin irritant) used by the employees when working on vehicles.

29 CFR 1910.1200(e)(1):Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met, and which also includes the following: (e)(1)(i): A list of the hazardous chemicals known to be present using a product identifier that is referenced on the appropriate safety data sheet (the list may be compiled for the workplace as a whole or for individual work areas).   a) On or about June 3, 2021, the employer did not have a written list of hazardous chemicals known to be present for chemicals such as but not limited to Pyroil Starter Fluid (flammable, inhalation hazard) and Carquest Wearever Brake Parts Cleaner (flammable, skin irritant) used by the employees when working on vehicles.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.   a) On or about June 3, 2021, the employer did not provide the employees with training at the time of their initial assignment for chemicals such as but not limited to Pyroil Starter Fluid (flammable, inhalation hazard) and Carquest Wearever Brake Parts Cleaner (flammable, skin irritant) that were used when working on vehicles.

29 CFR  1910.132(d)(2):The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  a) On or about June 3, 2021, the employer did not verify that a workplace hazard assessment had been performed for mechanics who were exposed to chemicals such as Carquest Wearever Brake Parts Cleaner (skin irritation of hands), welding (fumes, sparks),  and heavy parts (broken bones and bruising of feet) through a written certification.
