29 CFR  1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:  a) Top Tech, Inc. Body Shop: On or about June 3, 2021 and at times prior, employees were exposed to respiratory hazards while wearing a half mask elastomeric respirator to perform spray operations. The employer failed to ensure all employees had a medical evaluation prior to respirator use.
