29 CFR 1910.23(b)(8): The employer did not ensure that ladders were used only for the purposes for which they were designed: On and before June 3, 2021, the employer did not ensure that a 6-foot Werner Step Ladder was used in accordance with manufacturer's requirements. Employees would use both the second to top and top step of the ladder to access and egress from an 8-foot walking and working surface.

29 CFR 1910.23(c)(11): The employer did not ensure that portable ladders used to gain access to an upper landing surface had side rails that extended at least 3 feet (0.9 m) above the upper landing surface: On and before June 3, 2021, employees used a 6 foot step ladder to gain access to the top of a 8 foot high grinder, and the employer did not ensure that the ladder extended at least 3 feet above the upper landing surface.
