29 CFR  1926.451(g)(1):Each employee on a scaffold more than 10 feet above a lower level was not protected from falling to that lower level:  (a)Econo Lodge North at 5100 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to June 6, 2021 the employer did not ensure that employees were protected from falls while working within a Haugen basket, model MNP04X118, connected to the Skyjack SJ843 TH rough terrain forklift and no fall protection in place.  Employees were working within the basket with no fall protection in place while the forklift was being re-positioned.  This condition exposed employees to fall hazards greater than 10 feet.

29 CFR  1926.502(d)(16)(iii):Personal fall arrest systems, when stopping a fall, were not rigged such that an employee could not free fall more than 6 feet (1.8 m) nor contact any lower level:  (a)Econo Lodge North at 5100 North Cliff Avenue, Sioux Falls, SD 57104:  On or about and at times prior to June 6, 2021 the employer did not ensure that an employee that was utilizing a fall protection system while installing foam board on a commercial property was protected from contacting the ground in the event of a fall due to the system being rigged inappropriately.  This condition exposed the employee to impact with the ground in the event of a fall.

This condition exposed employees to a fall hazard of greater than 15 feet.

29 CFR  1910.178(l)(1)(i):The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Econo Lodge North at 5100 North Cliff Avenue, Sioux Falls, SD 57104 : On or about and at times prior to June 7, 2021 the employer did not ensure a forklift operator was trained in the operation of powered industrial trucks in that, an operator was not trained in the use of the Skyjack SJ843 TH Rough Terrain Forklift prior to use. This condition exposed the employee to the hazard of improper forklift operation.   Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace.  Abatement Note: The requirements applicable to construction work under 1926.602(d) are identical to those set forth at 1910.178(l) of this chapter.
