29 CFR OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to crushing injuries from overturning forklifts while operating them without using operator restraint systems (seatbelts): Location - 10 Creek Brook Dr., Haverhill, MA 01832 - Dock 18. On or about 6/8/2021, a forklift was being operated without the use of the seatbelt, in that the seatbelt was fastened behind the seat, exposing the operator to crushing injuries in the event the forklift overturned.

On or about 6/8/2021, an employee who had not been trained and evaluated in safe Powered Industrial Truck operation, operated a Powered Industrial Truck in order to load the back of a tractor-trailer truck.

29 CFR 1910.178(l)(3)(i)(M): Powered industrial truck operators shall receive initial training in the following topics to include but not limited to operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicle that the employee is being trained to operate: On or about 6/8/2021, an employee was operating a powered industrial truck in the back of a tractor-trailer truck when the tractor-trailer truck driver pulled away from the dock and the forklift fell to the ground. Employees did not receive training to ensure the truck-restraint system was set and activated in order to prevent such incidents.
