The employer required employees to wear N95 respirators in their shifts when caring for suspected and confirmed patients with COVID-19.

29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (a) On or about June 4, 2021 at at times prior thereto, the employer did not provide a medical evaluation to determine each employee's ability to use a N95 respirator before requiring the use. The employer required employees to wear the N95 respirators while providing care to suspected and confirmed positive COVID-19 residents.
