29 CFR  1926.454(a):The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a) Express Greenhouse, Inc. on or about June 4, 2021, at the site address of 1101 Rye Beach, Huron, Ohio:  The employer did not ensure employees working from a Sunbelt Rental Genie GS3369RT Scissor lift were adequately trained in the recognition of hazards associated with this type of mobile scaffold.  Untrained employees operating the unit in this condition were exposed to operational hazards, such as but not limited to falls.

29 CFR  1904.39(a)(2):The employer did not report within 24-hours a work-related incident resulting in in-patient hospitalization, amputation or the loss of an eye.  a) Express Greenhouse, Inc. on or about June 4, 2021, at the site address of 1101 Rye Beach Road, Huron, Ohio: The employer failed to report an employee hospitalizing following a worksite incident (employee fell approximately 15-20 feet from a scissor-lift).  The employer or employer representative failed to contact the Toledo Area Office or the 24 hour OSAH number to notify the agency of an employees hospitalization within 24 hours of receiving the injuries.  The employer later contacted the OSHA Office on June 8, 2021.
