29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person(s) On or about June 09, 2021, and at times prior thereto, employees were exposed to a struck-by hazard, while operating a Caterpillar 321D LCR without a competent person inspecting or verifying if the quick coupler pins were engaged when the bucket was laid on the spoil pile adjacent to the excavation.

29 CFR 1926.20(b)(3): Machinery, tool(s), material(s), or equipment which was not in compliance with the applicable requirement(s) of 29 CFR 1926 was not prohibited, and/or was not either identified as unsafe by tagging, or locking the controls to render them inoperable, or physically removed from its place of operation. On or about June 09, 2021, and at times prior there to, employees were exposed to a struck-by hazard while operating a Caterpillar 321D LCR that did not have a working buzzer to warn the operator the coupler switch was in the open position.
