1910.178(l)(6)  Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  On or about June 15, 2021, the employer had not ensured that each employee operating the Towmotor Model TGP25 LP Forklift had received training as required by the standard to safely and competently operate the lift prior to use.

29 CFR  1910.28(b)(1)(i):(1) Unprotected sides and edges.  (i) Except as provided elsewhere in this section, the employer must ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2 m) or more above a lower level is protected from falling by Guardrail systems, Safety net systems or Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems.  On or about June 15, 2021, employees of Willow Springs S.R.A. were not protected from falls of greater than four feet while working from the storage platforms in the back building of the facility.
