29 CFR 1926.501(b)(13):Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501(b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) New residential construction, Lot D107, Roof: On or about 6/17/2021, and at times prior, the employer exposed employees to fall hazards , in that a complete fall protection system was not provided to employees who were installing shingles on a 12:12 pitched roof at heights approximately 19 feet 4 inches to the lower level.

29 CFR 1926.1053(b)(1):Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder. a) New residential construction Lot D107, Roof: On or about 06/17/2021, the employer exposed employees installing shingles to fall hazards of 19-feet, 4-inches to the lower level, in that a ladder with extended side rails only extended approximately one foot above the upper landing surface and was not secured to the structure.
