29 CFR 1926.501(b)(13):Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): (a) On June 23, 2021 and at times prior thereto; employees were exposed to fall hazards while performing roofing activities at heights ranging from approximately 8 to 25 feet without fall protection. Employees were loading shingles on a 5/12 roof, securing ice and water barrier, and installing/securing roofing underlayment. Note: Abatement certification and documentation are required for this item.

29 CFR 1926.503(a)(1):The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards: (a) On June 23, 2021 and at times prior thereto; employees were exposed to fall hazards while performing roofing activities without fall protection in place. Employees were working at heights ranging from approximately 8 to 25 feet on a 5/12 roof in winds up to 60 miles per hour. Note: Abatement certification and documentation are required for this item.

29 CFR 1926.1053(b)(1):Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On June 23, 2021; employees were exposed to falls of approximately 8 feet while using a ladder to access the first floor landing. The ladder extended approximately 1.5 feet above the upper landing surface being accessed. (b) On June 23, 2021; employees were exposed to falls of approximately 25 feet while using a telescoping multi-position ladder to access the second floor landing. The ladder extended approximately less than 1 foot above the upper landing surface being accessed. Note: Abatement certification is required for this item.
