29 CFR  1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:  a) Jeremy Corbett M.D., PLLC. located at 43-01 23rd Street suite #300, Long Island City. NY 11101: The employer required employees to wear N95 respirators while administering  COVID-19 tests at the patients' places of residence and proving medical services to suspected or confirmed positive COVID-19 patients.  The employer did not develop and implement a written respiratory protection program; on or about July 1 to July 21, 2021.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

NY 11101: The employer did not provide a medical evaluation to determine each employee's ability to wear  N95 filtering facepiece respirators before requiring use.  The employer required employees to wear respirators while administering  COVID-19 tests at the patients' places of residence and providing medical services to suspected and confirmed positive COVID-19 patients; on or about July 1 to July 21, 2021.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

NY 11101: The employer did not provide a fit test to all employees required to wear N95 filtering facepiece respirators prior to the initial use of the respirator.  The employer required employees to wear the respirators while providing care and administering COVID-19 tests to suspected and confirmed positive COVID-19 patients at the patients' places of residence; on or about July 1 to July 21, 2021.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

NY 11101:  Records for administered fit tests provided to employees, who were required to wear N95 filtering facepiece respirators while providing care and administering COVID-19 tests to suspected and confirmed positive COVID-19 patients at the patients' places of residence were incomplete. Records failed to include required information such as, but not limited to, missing the type of fit test, date last tested, the results of the test, and the make, model, and size of the respirator tested; on or about July 1, 2021.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
